Why It Matters

Rulings on character evidence will shape what narrative jurors hear and constrain the defense’s ability to impeach the victim’s reputation, potentially affecting the trial’s outcome. Firsthand witness accounts of the boat trip and the defendant’s peaceful reputation could nonetheless bolster the defense’s portrayal of events.

Summary

On Day 3 of the high-profile boat strangling trial, judges and attorneys sparred over whether evidence of the alleged victim’s character and prior conduct is admissible, with the court limiting such testimony absent a self-defense claim. The prosecution argued much of the proposed testimony would be collateral and irrelevant, while defense counsel sought to introduce witnesses to attest to the defendant’s peaceful reputation. The court then called Sebastian Espinosa, a close friend, who testified about the April 24, 2022 boat trip to Lake Boca — saying the group drank, that the defendant and the victim appeared amicable on arrival, and that the defendant has a reputation for not being aggressive. The hearing focused on narrowing permissible testimony and preserving jury focus on charged conduct rather than collateral character issues.

Original Description

Florida man Cole Goldberg is accused of trying to strangle and drown his girlfriend, Caroline Schwitzky, during an argument on a boat at Lake Boca during Boca Bash. Schwitzky, who appeared on the 2016 season of TLC’s reality show 90 Day Fiancé, reportedly escaped by jumping into the water, but Goldberg allegedly followed her and held her underwater by the throat. Goldberg faces charges of attempted second-degree murder and battery.
