The Nova Scotia Supreme Court ruled that accepting a union‑covered job makes a person an employee under the collective bargaining agreement, even if they never start work. Beverly Margaret Gentleman’s rescinded offer was deemed a termination of a probationary employee, placing the dispute within the exclusive jurisdiction of labour arbitration. The court emphasized that the collective agreement’s definitions create employment status at the moment of acceptance, not at the first day on the job. Consequently, courts cannot hear such claims; arbitrators may extend grievance deadlines when justified.
