John Risley’s CFFI Ventures Inc. has moved its $1.4 billion debt restructuring into federal court under the Companies' Creditors Arrangement Act after creditors rebuffed a provincial plan that would hand assets to its largest lender, HPS Investment Partners. The Nova Scotia Supreme Court approved the shift, and FTI Consulting Canada was named monitor to protect creditor interests. CFFI still intends to transfer assets to HPS, but now under the more supervised CCAA framework, which offers greater creditor voting rights but higher legal costs. The Canada Revenue Agency also contested the provincial approach, claiming a $331 million tax claim.
